Terms of Service

EUROPEAN NETWORKS OÜ (“Company”, “we”, “us”, “our”) provides hosted website management platforms, domain registration, website hosting services and related services (the “Services”). These Terms of Service (“Terms”) govern all use of the Services.

I. Conditions

By subscribing to any of the Services and opening an account (“Account”), you (“Customer”) agree to be legally bound by these Terms. These Terms apply to all Accounts and form a legally binding agreement between you and EUROPEAN NETWORKS OÜ.

We reserve the right to update these Terms at any time. The latest published version on our website shall apply.

II. Services

2.1 We use reasonable efforts to provide continuous Services. However, we shall not be liable for delays, interruptions, data loss, force majeure events, governmental actions, or failures outside our reasonable control.

2.2 We shall not be liable for indirect or consequential damages including loss of business, profits, data, savings or contracts, except where liability cannot be excluded under applicable law.

2.3 Maintenance may require temporary suspension of Services. Notice will be provided where reasonably possible.

2.4 The Customer may not resell or transfer Services except through our official affiliate program.

2.5 Customer acknowledges that certain registration data (including IP address allocations) may be disclosed to RIPE NCC in accordance with applicable policies.

2.6 The Customer agrees to the Data Processing Agreement, which forms an integral part of these Terms.

III. Acceptable Use and Prohibited Content

3.1 The Services may only be used for lawful purposes under applicable European Union and Estonian law.

3.2 The following content and activities are strictly prohibited:

  • Illegal activities under EU or Estonian law;
  • Fraud, phishing, identity theft or data harvesting;
  • Spam, unsolicited bulk email, spamvertising;
  • Hosting unlicensed pharmaceuticals, illegal gambling, or unlawful adult content;
  • Security breaches, hacking, malware distribution, or DOS attacks;
  • Terrorist content as defined under Regulation (EU) 2021/784.

3.3 We reserve the right to remove content or suspend Accounts where a violation is identified.

IV. Terrorist Content Compliance (Regulation (EU) 2021/784)

4.1 In accordance with Regulation (EU) 2021/784, Customers are strictly prohibited from uploading, transmitting, storing or disseminating terrorist content.

4.2 “Terrorist content” includes content that:

  • Incites or solicits the commission of terrorist offences;
  • Promotes or glorifies terrorist organisations or activities;
  • Provides instructions for committing terrorist acts;
  • Assists recruitment for terrorist groups.

4.3 We shall remove or disable access to terrorist content without undue delay upon detection.

4.4 Removal orders issued by competent authorities shall be complied with within one (1) hour of receipt.

4.5 We may use automated detection tools combined with human review to identify terrorist content.

4.6 Context shall be assessed before removal where content appears for educational, journalistic, academic, artistic or research purposes.

4.7 Where content is removed, we shall notify the Customer unless prohibited by competent authority for public security reasons.

4.8 Removed terrorist content and related data shall be securely retained for six (6) months, unless a longer retention period is required by law or court order.

V. Complaint and Redress Mechanism

5.1 Customers have the right to challenge removal or suspension decisions.

5.3 Complaints shall be reviewed objectively and a decision issued within two (2) weeks of receipt.

5.4 If the complaint is upheld, content shall be reinstated without delay.

5.5 This mechanism does not limit the Customer’s right to judicial remedy.

VI. Security and Network Integrity

Customers may not attempt to compromise security, gain unauthorized access, interfere with networks, or conduct DOS attacks.

Violation may result in immediate suspension and cooperation with law enforcement authorities.

VII. Suspension and Termination

We may suspend or terminate Accounts:

  • Immediately in case of serious violation including terrorist content;
  • Upon non-payment;
  • Upon abuse complaints substantiated after investigation.

Termination shall be proportionate and compliant with applicable EU law.

VIII. Limitation of Liability

Nothing in these Terms excludes liability where such exclusion is unlawful under EU or Estonian law.

Subject thereto, our liability shall be limited to the annual fees paid by the Customer during the year in which liability arose.

IX. Indemnity

The Customer agrees to indemnify and hold harmless EUROPEAN NETWORKS OÜ against claims arising from misuse of the Services or breach of these Terms.

X. Governing Law

These Terms shall be governed by the laws of the Republic of Estonia. Disputes shall be subject to the exclusive jurisdiction of Harju County Court, Estonia.
